Abstract
In 1983 the Federal Constitutional Court of Germany “discovered” the fundamental right of data protection. However, it still remains a widely discussed problem whether juridical persons benefit from this fundamental right in the same way as individuals. This leads to the important questions whether corporate data in particular enjoys a sufficient degree of constitutional protection. The text analyses the protection of corporate secrets through Art. 12, 14 Basic Law and whether protection afforded by these provisions is sufficient. The text argues that Art. 19 (3) Basic Law extends the fundamental right of data protection to juridical persons.
