Abstract

It has been more than two years since the pandemic hit the world after the confirmation of COVID-19 at the end of 2019. While new variants have impacted the society seriously, rapid development of vaccines have succeeded in avoiding serious conditions. By contrast, criticisms on intellectual property (IP) regime are claimed in relation to COVID-19 vaccines and they have supported a proposal to waive IP protections under the TRIPS Agreement. This report is aimed at examining if mediation can be another effective solution to foster prompt development and distribution of vaccination in future pandemics. Firstly, the report analyses how mediation has been
used to overcome IP disputes in the UK, the US and Japan. Secondly, the report analyzes the existing IP frameworks for COVID-19 vaccines. Lastly, the paper discusses on effective use of mediation as a solution to disputes arising in pandemics to enable prompt development and distribution of vaccination.
