Abstract

Examines the rule conferring special jurisdiction over multiple defendants under Regulation 44/2001 (Brussels I Regulation) art.6(1). Considers the policy considerations justifying the rule and looks at problems with the interpretation of art.6(1) in practice, with reference to European Court of Justice rulings and decisions of Member States' national courts. Explores the relationship between art.6(1), the protective jurisdiction rules contained in Ch.2 ss.3 to 5, and the exclusive jurisdiction rules in arts.22 and 23. Puts forwards proposals for the reform of art.6(1).
