Abstract

A kötet a jog gazdasági elemzését a társadalomtudományokban általánosan elfogadott, ugyanakkor a hazai jogi gondolkodásban alig ismert és gyakran félreértett rational choice paradigma jogtudományi alkalmazásaként értelmezi és értékeli.
A jog gazdasági elemzésének alapelemeit, logikai szerkezetét, normatív előfeltevéseit, irányzatait és főbb tartalmi következtetéseit a körülhatárolt várakozások jegyében áttekintve rámutat a rational choice paradigma jogfilozófiai jelentőségére.
Ugyanakkor a mérsékelt optimizmus jegyében azt is vizsgálja, hogy a közgazdasági elemzés mennyiben járulhat hozzá az ésszerű és tárgyszerű jogpolitikai viták és döntések gyakorlatának erősödéséhez. A szerző másfél évtizedes kutatásait összefoglaló munka a racionális döntések elméletére épülő jogtudomány és joggyakorlat előtt álló etikai, politikafilozófiai, közpolitikai és jogdogmatikai lehetőségekkel és kihívásokkal a nemzetközi szakirodalomban is újszerű módon néz szembe.

[The volume interprets and evaluates the economic analysis of law as a legal application of the rational choice paradigm, which is generally accepted in the social sciences, but is little known and often misunderstood in Hungarian legal thinking.
Reviewing the basic elements, logical structure, normative presuppositions, tendencies and main substantive conclusions of the economic analysis of law, it points out the legal philosophical significance of the rational choice paradigm in the light of defined expectations.
At the same time, in the spirit of moderate optimism, it also examines the extent to which economic analysis can contribute to the strengthening of the practice of reasonable and objective legal policy debates and decisions. The work, which summarizes the author's research over a decade and a half, confronts the ethical, political philosophical, public policy and legal dogmatic opportunities and challenges facing jurisprudence and legal practice based on the theory of rational decisions.]
