Abstract

Comments on Barclay (Sean) v HM Advocate (HCJ Appeal) on whether there were exceptional circumstances, within the meaning of the Firearms Act 1968 s.51A(2), to permit departure from the minimum sentence of five years' imprisonment for possession of component parts of a prohibited weapon, namely modified SA80 automatic assault rifles stolen from an army cadet building.
