Abstract

This 560-page Stair Society volume contextualizes, explains, and presents for the first time the judgements of the first Commissaries of Edinburgh in matrimonial causes as they succeeded to the courts of the Catholic Church in Scotland during the Scottish Reformation. The volume traces the Commissaries' retention of Canon law on a judgement-by-judgment basis, as well as their acceptance of new Protestant law reforms during the critical years of the development of early Scots marriage law out of the European Canon law of the Catholic Church while under the influence of international Calvinism. The volume is comprised of a 60,000-word introduction, 192 edited transcriptions of sixteenth-century Scottish matrimonial judgements - each with a detailed contextualising and explanatory introduction concerning points of law, sources cited, and arguments presented -, together with three separate indexes (which are essential for the exploitation of the transcribed sixteenth-century sources, which are for the most part in phonetically spelt Older Scots or late-medieval Latin) and a glossary of Scots procedural terminology, Latin phrases, feast and term days, Scots words. The indexes of places and persons also give the standardized modern day usages of such names alongside the mid-sixteenth century Scots variants.
