Abstract

Discusses McLellan (John) v Procurator Fiscal, Glasgow (SAC) giving guidance on the operation of guilty plea discounting under s.196 of the Criminal Procedure (Scotland) Act 1995, and whether compensation, either in the form of a compensation requirement of a community payback order (CPO) or a compensation order made under the 1995 Act s.249, should be subject to a discount.
