Abstract
I sistemi di rating and reviews rappresentano un meccanismo di autoregolamentazione privata largamente diffuso nella pratica delle piattaforme online e di quelle di sharing mobility in particolare. Il funzionamento di tali sistemi è stato oggetto di numerosi studi empirici e analisi giuridiche soprattutto nell’ambito del diritto dei consumatori, del diritto del lavoro e del diritto della concorrenza. Il paper intende contribuire al dibattito da una prospettiva non ancora largamente investigata, ossia come i sistemi di rating e review interagiscano con il quadro giuridico europeo a protezione dei dati personali.
Come caso di studio si considererà il sistema di rating utilizzato da Uber, una delle piattaforme per la sharing mobility maggiormente utilizzate a livello mondiale.
The rating and reviews systems are a self-regulation mechanism widely used by online platforms, especially in the sharing mobility sector. Such systems have been already analysed in empirical studies and legal contributions, especially in the field consumer law, labor law and competition law. The paper aims to originally contribute to the current debate from a relatively underinvestigated
perspective: how rating and review systems interact with the European data protection framework. As a case study, the paper will focus on the rating system adopted by Uber, one of the largest sharing mobility platforms worldwide.
